Introduction
1.1 These Terms and Conditions apply to your use of AtlonAI, a service provided by Atlon AI (trading as AtlonAI) ("AtlonAI", "we", "us", "our").
1.2 By creating an account, accessing, or using AtlonAI, you agree to be bound by these Terms. If you do not agree, you must not use the service.
1.3 If you are using AtlonAI on behalf of a company or organisation, you confirm that you have authority to accept these Terms on its behalf
Definitions
In these Terms:
2.1 "Service" means the AtlonAI software platform, AI tools, training content, templates, support, and any related services we provide.
2.2 "Account" means your registered user account for access to the Service.
2.3 "User Content" means any data, text, files, information, or materials you upload, enter, or create when using the Service.
2.4 "Subscription" means a paid plan for ongoing access to the Service.
Eligibility and Accounts
3.1 You must be at least 18 years old to use AtlonAI.
3.2 You agree to provide accurate and complete information when creating an account and to keep it up to date.
3.3 You are responsible for keeping your login details secure and for all activity under your account. If you suspect unauthorised use, you must notify us promptly at [email protected].
Use of the Service
4.1 You may use the Service only for lawful business purposes and in line with these Terms.
4.2 You must not:
a) Use the Service to send spam or unlawful marketing.
b) Upload or process unlawful, harmful, defamatory, or infringing content.
c) Attempt to gain unauthorised access to any part of the Service or related systems.
d) Reverse engineer, copy, or try to bypass security or usage limits.
4.3 You are responsible for how you use the Service and for ensuring that your use complies with all applicable laws and regulations, including marketing, privacy, and data protection rules.
Confidentiality and Non-Disclosure
5.1 As a user of AtlonAI, you agree not to share, distribute, or disclose any private training materials, videos, call recordings, links, or proprietary information obtained through AtlonAI with people outside the AtlonAI customer community.
5.2 This includes, but is not limited to:
a) Training videos and onboarding content.
b) Internal strategies, methods, and workflows shared within the Service.
c) Templates and proprietary documents that are not publicly available.
5.3 You may share outputs created for your own business (such as documents and campaigns) with your team and clients. You must not redistribute AtlonAI training content or core templates as your own product or as a competing service.
Intellectual Property
6.1 AtlonAI, including all software, AI models, workflows, templates, documentation, branding, and training materials, is owned by Atlon AI or its licensors.
6.2 We grant you a limited, non-exclusive, non-transferable licence to use the Service and included templates for your internal business purposes while your Subscription is active.
6.3 You must not copy, resell, or sub-license the Service, or create a competing product using AtlonAI content or components.
6.4 You retain ownership of your User Content. You grant us a licence to host, process, and use your User Content only as needed to provide and improve the Service.
Data Protection and Privacy
7.1 We process personal data in line with UK GDPR and other applicable data protection laws.
7.2 Our Privacy Policy explains how we collect, use, and protect personal data. By using AtlonAI, you agree to that policy.
7.3 You are the data controller for the personal data you upload into the Service (such as your customers' details). You are responsible for having a lawful basis to process that data and for providing any required notices to your own customers.
7.4 You must not upload special category data or highly sensitive personal data into the Service unless you have appropriate safeguards and a lawful basis.
Third-Party Services
8.1 AtlonAI connects with third-party platforms, including telephony providers, email and SMS providers, and other tools.
8.2 Use of any third-party service is also subject to that provider’s terms and policies. You are responsible for reviewing and complying with those terms.
8.4 If a third-party provider changes or ends a feature, integration, or pricing model, this may affect how some features of AtlonAI work. In such cases, we may adjust, replace, or remove affected features without liability for any resulting loss.
Marketing Activities, Legal Compliance, and Liability
9.1 AtlonAI provides tools and templates for SMS, email, telephony, and other marketing and automation activities.
9.2 You understand that these activities can involve legal risk, including fines or complaints under laws such as:
UK GDPR and PECR.
Local spam and telemarketing rules in your jurisdiction.
9.3 You are solely responsible for:
a) Ensuring your contact lists are collected and used lawfully.
b) Obtaining valid consent where required.
c) Providing opt-out options where required.
d) Configuring campaigns in compliance with applicable laws and industry rules.
9.4 AtlonAI is not liable for any legal repercussions you face as a result of using the Service, including but not limited to SMS marketing, email marketing, or cold calling activities.
9.5 You agree that AtlonAI is not responsible for any legal actions taken against you and will not be liable for any fines, claims, losses, or penalties arising from your use of our Service.
Billing and Payment Responsibilities
10.1 AtlonAI subscriptions and usage-based services (such as calls, SMS, AI credits, or email sends) are charged on a recurring basis in line with your selected plan.
10.2 You must provide valid payment details (such as a credit or debit card) for all charges linked to your use of AtlonAI and any connected services run through our GoHighLevel instance or other partners.
10.3 You must use your own payment card for all billing related to SMS, email, calls, AI usage, and other variable costs.
10.4 If you fail to add or update your payment information and AtlonAI incurs costs on your behalf (for example, telephony, SMS, or email charges), you agree that:
a) We may invoice you for these costs.
b) Payment will be due within 7 days of the invoice date.
c) We may suspend or limit your account until payment is received.
10.5 We will make reasonable efforts to keep variable costs efficient, but you are responsible for all charges incurred through your account due to your campaigns, automations, and settings.
Subscription Term, Renewal, and Cancellation
11.1 Subscriptions are billed in advance on a monthly or annual basis, as selected at signup.
11.2 Unless cancelled in line with this clause, your Subscription will renew automatically at the end of each billing period.
11.3 You can cancel your Subscription at any time through your account settings or by contacting [email protected].
11.4 If you cancel, your access will continue until the end of the current paid billing period. No further recurring charges will apply after that period.
11.5 Except as set out in the refund terms in section 12, fees already paid are non-refundable.
Refund Terms
12.1 A limited refund policy applies only to the first 48 hours after your first payment on your first AtlonAI Subscription. It does not apply to renewals, usage charges, or add-on services.
12.2 To be eligible for a refund within the first 48 hours you must:
a) Email [email protected] within 48 hours of your first payment.
b) Have watched the introduction or onboarding video in full.
c) Have attended an onboarding call with our team (or made a reasonable effort to attend a scheduled call).
12.3 If these conditions are met, the next step is to schedule an exit call or exit interview with a member of our team. The purpose is to understand your experience and improve the product.
12.4 After the exit interview is completed and any required information is provided, an approved refund will be processed within 3 to 5 business days back to your original payment method.
12.5 We reserve the right to refuse a refund if:
a) You request it after the 48-hour window has passed.
b) You have not completed the onboarding steps described above.
c) There is evidence of misuse, abuse, or breach of these Terms.
Service Availability and Changes
13.1 We aim to provide reliable access to the Service, but we do not guarantee that it will be available at all times.
13.2 The Service may be temporarily unavailable due to maintenance, updates, or issues outside our control. We will try to give reasonable notice of planned maintenance where practical.
13.3 We may modify, improve, or remove features from the Service at any time to respond to technical, legal, or business needs. Where changes are significant and affect core features, we will use reasonable efforts to notify you.
Disclaimers
14.1 The Service is provided on an "as is" and "as available" basis.
14.2 We do not promise that the Service will be error-free, uninterrupted, or fit for your specific purpose.
14.3 Any strategies, templates, or recommendations provided by AtlonAI or its AI models are for guidance only. You remain responsible for your own business decisions and compliance with laws and regulations.
Limitation of Liability
15.1 Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by negligence, or for fraud.
15.2 Subject to clause 15.1, AtlonAI will not be liable for:
a) Loss of profits, revenue, or business.
b) Loss of data or corruption of data.
c) Loss of goodwill or reputation.
d) Indirect or consequential loss or damage.
15.3 Subject to clauses 15.1 and 15.2, our total aggregate liability to you arising out of or in connection with the Service and these Terms will not exceed the total fees you have paid to AtlonAI in the 12 months immediately before the event giving rise to the claim.
Indemnity
16.1 You agree to indemnify and hold harmless AtlonAI, its directors, employees, and contractors from and against any claims, losses, costs, and expenses (including reasonable legal fees) arising from:
a) Your breach of these Terms.
b) Your misuse of the Service.
c) Your failure to comply with marketing, privacy, or data protection laws.
d) Any claim made by a third party relating to your use of the Service or your User Content.
Termination and Suspension
17.1 We may suspend or terminate your access to the Service, or part of it, with immediate effect if:
a) You materially breach these Terms.
b) You use the Service in a way that is unlawful, abusive, or harmful to us, other users, or any third party.
c) Required by law or by a court or regulator.
17.2 If we terminate for cause under clause 17.1, you will not be entitled to any refund.
17.3 You may terminate your use of the Service at any time by cancelling your Subscription and stopping use of the Service.
17.4 Following termination, your account may be closed. We may retain certain data as required by law or for legitimate business purposes, in line with our Privacy Policy.
Changes to These Terms
18.1 We may update these Terms from time to time.
18.2 If we make material changes, we will notify you by email or through the Service. The updated Terms will take effect from the date stated in the notice.
18.3 Your continued use of the Service after the updated Terms take effect will mean that you accept them. If you do not agree, you must stop using the Service.
Governing Law and Jurisdiction
19.1 These Terms and any dispute arising out of or in connection with them are governed by the laws of England and Wales.
19.2 The courts of England and Wales will have exclusive jurisdiction over any dispute relating to these Terms or the Service, except where local law gives you mandatory rights to bring a claim in another jurisdiction.
